Woman Sues McDonald's Over Spilled Hot Chocolate

A mother in Illinois is suing McDonald's for burns that her daughter suffered when hot chocolate handed to her from the drive-through window spilled on the girl's leg, according to court documents.

The lawsuit was filed in Cook County Circuit Court by Vicki LaRocco, a Northgate resident who is alleging that the lid on the hot chocolate she received from a Schiller Park McDonald's restaurant was haphazardly secured, causing scalding liquid to spill on her daughter. The lawsuit claims that the girl suffered "severe pain and scarring."

The complaint states that McDonald's should have been aware that the temperature of its hot chocolate is excessive and would potentially lead to injury. A spokesman for McDonald's responded that the lawsuit's allegation are just that: "allegations."

In 1994, a jury awarded a woman more than $2 million after she suffered burns when her McDonald's coffee spilled on her lap, although the amount was later reduced by a judge.
